FSvendor Online Privacy Notice 

This Online Privacy Notice (Privacy Notice) applies to FSvendor online interface (i.e., website and mobile application), including all FSvendor affiliate or subsidiary online interface that links to this Notice, (each, a Site, and, collectively, Sites). The term "FSvendor" or "we" or "us" or "our" in this Notice refers to all FSvendor affiliates or subsidiaries of FSvendor that link to this Notice. This Notice describes how our Sites may collect, use, and share information from or about you. 

 

Acceptance, providing your information 

By visiting, using, registering, requesting services associated with this online interface, you acknowledge and consent that your personal information may be used as described within this Online Privacy Notice. 

 

Collection of Personal Information 

Personal Information means any personally identifiable information such as information you provide via forms, applications, and/or other online fields such as your first and last name, email address, zip code/postal code, billing address, mailing address, phone number(s), account number, username and password, photo, and any other personal or digital identifiable information you choose to provide. As permitted by applicable law, unless otherwise provided in this Online Privacy Notice or our statements at the point of collection, (i) non-Personal Information/ Personal Data (“non-personal information”) may be used and shared without obligation to you. 

 

We collect Personal Information from you only when you voluntarily submit it to obtain certain information, including without limitation: (A) request(s) to find out more about our program(s); (B) request(s) to contact us; (C) opt-in to any program(s) or service(s), and (D) request(s) to forward your information to one of our affiliates, third party servicers or clients.  

 

If you contact us, we collect Personal Information, which is retained or referred to the appropriate department for identification purposes, research and a prompt response. The information we collect is not used in any other way. 

 

Use of Personal Information 

 

We may use Personal Information: 

  • To respond to your inquiries and fulfill your requests. 

  • To deliver marketing communications that we believe may be of interest to you. 

  • To personalize your experience on the Site(s) and efficient use of the Site(s). 

  • To allow you to apply for products or services (e.g., to prequalify for a mortgage, notarize a document, apply for a financial product). 

  • To verify your identity and/or location in order to allow access to an account(s), opt in to service(s) online, conduct online transaction(s) and service(s), and to maintain measures aimed at preventing fraud and protecting the security of Personal Information. 

  • For business purposes, including data analysis, audits, developing and improving products and services, enhancing the Sites, and identifying usage trends. 

  • For risk control, fraud detection and and fraud prevention. 

  • To comply with laws and regulations, and other applicable legal requirements. 

  • To allow you to utilize features within our Sites by granting us access to information from your device such as geo-location. 

 

Collection of Non-Personal Information 

 

Our Sites may automatically collect certain information about you when you access or use our Sites. 

 

Even if you do not send us any Personal Information, like many sites, we obtain Non-Personal Information such as IP (internet protocol) addresses, browser types, the name of your ISP (internet service provider), etc. This information cannot be used to identify you personally and is explained in more detail below.

Certain information is collected by most browsers and/or through your device, such as your Media Access Control (MAC) address, device type, screen resolution, operating system version and internet browser type and version. We use this information to ensure Sites function properly, for fraud detection and prevention, and security purposes. 

 

 

Location-identifying Technologies: 

 

GPS (global positioning systems) software, geo-filtering and other geo-location technologies locate (sometimes precisely) you, or make assumptions about your location, for purposes such as verifying your location and delivering or restricting content based on your location. Certain other technologies, including pixel tags, web beacons, and clear GIFs, may be used in connection with some pages on Sites, downloadable mobile applications and HTML-formatted email messages to measure the effectiveness of our communications, to compile statistics about usage and response rates, to personalize/tailor your experience while engaging with us online and offline, for fraud detection and prevention, and for security purposes 

 

 

Use of Personal and Non-personal Information 

 

We use the Personal Information and the Non-Personal Information we collect on the Sites to answer your questions or address your inquiries and requests, for analytical purposes to help us improve the Sites and for our business generally. 

 

In order to provide efficient and reliable services and to improve our product(s) and service(s) available to you, one or more of FSvendor's affiliates may be given, or given access to, your Personal Information. When so sharing your Personal Information, we adhere to applicable legal and industry standards regarding the protection of Personal Information. 

 

 

Third Party Services 

 

Certain products and services we provide on our Sites may contain hyperlinks to other websites or locations, including notary and other services, which contain third party applications, content and tracking technologies that are operated by third parties ("Third Party Servicer(s)"). We make no representations and accept no responsibility or liability regarding the policies or business practices of such Third-Party Servicers and encourage you to familiarize yourself with their privacy policies before accessing them or otherwise providing them with your Personal Information/Personal Data.  In some cases, Third Party Servicers may each post terms and policies on a Third Party Service, in which case our terms and policies govern us and the Third Party Servicer’s terms and policies govern them. 

 

Except to the extent we combine information we receive from Third-Party Servicers with Personal Information and personal data we ourselves have collected via Sites and services, information and data obtained by us from a third party, even in association with the any product or service, is not subject to our limitations regarding Personal Information and personal data under this Privacy Notice. However, such information and data remain subject to any restrictions imposed on us by the third party, if any. Otherwise, the information collected, stored, and shared by Third Party Servicers remains subject to their privacy policies and practices, including whether they continue to share information with us, the types of information shared, and your choices on what is visible to others by Third Party Services. You should read the privacy notice of each Third-Party Servicer as these Third Party Services may use their own cookies, web beacons and other Tracking Technology to independently collect information about you.  

 

 

Sharing Your Information 

 

We do not rent or sell, or share with third parties the Personal Information and personal data we collect from you except (i) to provide information or services that you have requested, (ii) with your permission, or (iii) under the following circumstances: 

 

Our agents, vendors, consultants, and other service providers may have access to, or receive from us, your Personal Information/Personal Data, and other information about you, to carry out work on our behalf. However, we do not authorize, but strictly prohibit our service providers, including but not limited to, Third Party Servicers, from using your Personal Information/Personal Data for any purpose other than to provide assistance to us. 

 

There may arise special circumstances where it is necessary for us to disclose and use Personal Information and Non-Personal Information, such as: to enforce this online Privacy Policy; to protect our property or rights; to protect the safety of anyone; to investigate, prevent, or take action regarding illegal or improper activities; to carry out a merger or consolidation with another entity, a sale or transfer of some or all of our assets, or any similar transaction; or for other reasons we determine in good faith are necessary, appropriate, or required by law, such as when we respond to subpoenas, court orders, or other legal or administrative process.

We are very concerned about protecting private and Personal Information and personal data. We take aggressive steps in securing your information, including:

We train staff awareness of the types of information they are accessing and collecting and implement processes and protocols to keep it secure. We take action against those employees who do not adhere or follow our privacy processes and protocols relating to both past and current clients, customers, and consumers. 

  • Maintaining physical, electronic, and procedural safeguards that comply with applicable federal and state regulations to guard and protect personal Information and personal data.

Children 

 

Our Sites are not directed to children under the age of 18 ("Children"), and we do not knowingly collect any information, including Personal Information, from Children. 

International Use, Governing Law and Forum 

 

FSvendor makes no claims that materials on Sites are appropriate or may be downloaded for use in locations outside the United States. Access to Sites from countries or territories where such access is illegal or prohibited. Those who choose to access Sites outside the United States do so on their own initiative and are responsible for compliance with local laws. 

 

 

Governing Law and Jurisdiction 

 

This Privacy Policy and the resolution of any dispute related to this Privacy Policy shall be governed by and construed in accordance with the laws of the State of California without giving effect to any principles of conflicts of law and the venue for any disputes shall be in orange County, California. 

 

 

California Privacy Rights 

 

Under California law, California residents have the right to request in writing (1) to disclose of what Personal Information about them that we collect, use, and disclose, including the specific pieces of Personal Information about them that we have collected (referred to as an “access request” or a “request to know”); and (2) to delete any Personal Information about them collected or maintained by FSvendor (referred to as a “deletion request”) and (3) to opt out of any certain data sharing shared by FSvendor (referred to as a “opt out”) 

 

California customers may also designate an authorized agent to submit a California Consumer Rights Request on their behalf. To do so, please submit a request by sending a notice to the below listed address of fax number.

When submitting a request, we will need to: 

1. Provide your legal name, address, email address, and phone number. 

2. Identify specific action is required.  

3. And if submitted by designated authorized agent, provide their own name and email address, a statement indicating that they are acting as an authorized agent to submit a request on your behalf, and, if applicable, a statement indicating that you have provided them with a power of attorney that is valid under California law.  

 

Failure to provide all required information may result in our inability to properly address your specific action request.  

 

We will respond to such requests within 30 days of receipt.   

 

In accordance with California law, we have a policy of responding to only two access requests from a customer in a 12-month period. Please note that we are only required to respond to each customer once per calendar year.

This Online Privacy Notice is subject to change in order to accommodate changes to applicable law and regulatory requirements, new technologies, industry practices, regulatory requirements, or for other reasonable purposes.  We reserve the right to modify this Online Privacy Notice at any time by posting a notice on the Sites’ Home Pages. We encourage you to review the Online Privacy Notice periodically. 

 

Any changes to the Online Privacy Notice will become effective when the revised notice is posted on the
